VAUGHN v. CARBONDALE POLICE PENSION BOARD

On May 7, 2014 the Fifth District Appellate Court heard oral argument in Vaughn v. Carbondale Police Pension Board.  The trial court affirmed the Pension Board’s decision terminating the plaintiff’s disability pension pursuant to the restoration statutes.  The appeal raises issues regarding the sufficiency of the evidence, but more importantly, whether the Pension Board violated the plaintiff’s due process rights for denying plaintiff’s petition for a hearing.
