DOI TO RESUME ISSUING TAX LEVY RECOMMENDATIONS

Pension Funds with annual statements filed and accepted as of Frida, October 12, 2012 will have a suggested tax levy produced and available no later than November 30, 2012.

SECOND DISTRICT PUBLISHES ESCHBACH ORDER

On September 20, 2012 the Second District Appellate Court granted the motion to publish the order previously entered on August 17, 2012 in Eschbach v. The McHenry Police Pension Board as an Opinion.

The Second District affirmed the Pension Board’s decision denying the plaintiff’s application for a disability pension because she was not a police officer at the time she filed her application.

Chicago Court Hears Arguments On Governor Walker Law

On September 24, 2012 the Seventh Circuit Court of Appeals in Chicago heard oral argument over Wisconsin’s law restricting collective bargaining for most public workers.  Wisconsin appealed after a federal judge struck provisions of the law halting automatic union dues deductions and requiring unions to hold annual elections.

WISCONSIN JUDGE STRIKES DOWN LAW LIMITING COLLECTIVE BARGAINING

Judge Strikes Down Wisconsin Law That Effectively Ended Collective Bargaining For Public Workers

A Dane County Circuit Judge ruled that the law which limited collective bargaining rights for most Wisconsin public workers violated the U.S. and state constitutions.  Specifically, the Judge held that the law infringed on the public workers’ rights to free speech and free association and that it violated the equal protection clause by creating a separate class of workers who are treated differently.  Governor Walker, who faced a recall effort as a result of the law, vowed to appeal.
